They are desperate to make a case. This part is written by the lawyers, but OMD, it is so lacking:

Yes, they are trying to call bulldozing the East Wing an ALTERATION.

Later on they discuss the construction of certain buildings under NPS, but I would have to look each one up to see what the circumstances were.
