The DOJ has indicted sitting members before. According to the Washington Post, more than two dozen since 1980. Jim Trafficant was a big one; he refused to resign, even after he was convicted, and the full House voted to expel him. I remember when this happened. There was a Republican guy from NY indicted during the tRump years another from CA, I think, and another Repuke indicted and convicted last term on campaign finance charges.

So, it seems to me, there’s plenty of precedence for indictments. Don’t give up hope. The wheels of justice may turn too slowly for our tastes, but they do turn.
