12. They are relying on phrases in Dobbs.

First - allowing an exception for rape or incest would not change an abortion into not-an-abortion; it merely makes having an abortion legal.

Second - the phrases they are relying on in Dobbs for their new definition of abortion did not exist when the trigger/zombie laws were written, they are flat out wrong from a legal persepctive. Ohio's definition of abortion:

"abortion" means the purposeful termination of a human pregnancy by any person, including the pregnant woman herself, with an intention other than to produce a live birth or to remove a dead fetus or embryo.


Third - it appears that the phrases they are relying on from Dobbs are from hand-picked state-specific laws.
