(17,802 posts)It varies by state, but to be a felony in idaho the riot would have to have been planned at a penal institute, or have involved greater than $500 in damages, and/or possibly personal injury.
All rolled up, it isn't really that egregious an offense in and of itself.
Yes, they are white supremacist's. Yes, they were targeting an event that was LGBTQ related out of shear hatred. Yes, they are miserable people.
But being any of that isn't against the law in itself. Just as being a member of antifa or blm or the aclu is not illegal (yet).
And no real violence occurred. Luckily.
So strictly from a proportional legal penalty, the punishment is appropriate here. As much as we don't like it (and I don't), if the tables were turned and they nabbed a bunch of pro-choice activists heading to protest a right wing parade, I wouldn't want them to be sent away for life either.
So while it is frustrating that the penalties are so low, they are appropriate. IMHO, of course.
Now if there is a civil rights angle here, it should be pursued.
