..this morning my dtr sends me the info and i look him up and Spencer Thomas Simpson. OMG 20 and he just effed up his life. I think this is the house we drive by going into town..a HUGE TRUMP 2024 flag which is usually all wrapped around a tree. We always call the herd of deer in their front yard the 'trump deer'. Anyway hes about about 5 miles from me ( which rural-ly speaking makes him my neighbor)..bet his parents are SO proud..and i cant wait for the local newspaper to show his traitor face on the front page..

(5,215 posts)Of criminal conspiracy to riot.
I doubt that even if convicted, any of them will get more than time served at the time they are tried and convicted. Its also a stretch- as no actual riot occurred, so they likely would not get the top end if the punishment- which, in this case, is up to a year in jail, and/or a $5,000 fine.
And the jury will be of people from Idaho. So, thats in play as well.
We shall see.

(17,802 posts)They will likely go for pre-trial probation. No trial, no convictions - as long as they stay clean for a year or so.
sop
(18,647 posts)But it allowed them to be detained so as to not cause trouble. Which is probably the smartest thing the police could do given their options.

(31,309 posts)I have family in and around Cour d'alene and my niece's ex FIL and one of his brothers were arrested a lot of years ago for an attempted lynching IIRC.
also though I love my niece she's an unrepentant racist, covid denier, anti vaxxer...my sister has Alzheimer's and she's her caretaker so I will not cut ties with her at this point. But that area of ID, probably most of ID in fact, pretty damn racist.
What's ironic about my niece is that she moved to WA because they have the Medicaid expansion. For her health! Wasn't too proud to turn that down!

(2,843 posts)....Butler's Aryan Nations and the "American Redoubt Movement" changed all that for the worse. Southern Idaho is still very Mormon and very conservative and the state, in general was Trump's biggest supporters, bar none.

(37,113 posts)the comments. one of the biggest topics was where to move away from POC...."I'm starting to see mudpeople in my neighborhood where do I move?". Idaho was one of the suggestions... I would assume it's getting concentrated with racists.

(31,309 posts)is that their compatriots will see them as heroes. Misdemeanor charges when they were all dressed up in riot gear with weapons?!
I think their bail is $300. disgusting.
getagrip_already
(17,802 posts)It varies by state, but to be a felony in idaho the riot would have to have been planned at a penal institute, or have involved greater than $500 in damages, and/or possibly personal injury.
All rolled up, it isn't really that egregious an offense in and of itself.
Yes, they are white supremacist's. Yes, they were targeting an event that was LGBTQ related out of shear hatred. Yes, they are miserable people.
But being any of that isn't against the law in itself. Just as being a member of antifa or blm or the aclu is not illegal (yet).
And no real violence occurred. Luckily.
So strictly from a proportional legal penalty, the punishment is appropriate here. As much as we don't like it (and I don't), if the tables were turned and they nabbed a bunch of pro-choice activists heading to protest a right wing parade, I wouldn't want them to be sent away for life either.
So while it is frustrating that the penalties are so low, they are appropriate. IMHO, of course.
Now if there is a civil rights angle here, it should be pursued.

(15,464 posts)this probably isn't going anywhere (sadly). But the material facts just don't add up to a great deal. Kudos to the police for acting preemptively here - but they just don't have much in the way of 'crime' in which to charge.

(17,802 posts)He is charged with a misdemeaner. In Idaho.
He will likely not even serve time. With no record, and no weapons found, and no violence occurring, he will likely get pre-trial probation. That would result in no conviction and no jail time.
At most he won't be able to get a security clearance for a while. Some employers might decide not to hire him, depending on their screening criteria. Others won't even pause at it.
But in general pre-trial probation with no conviction will fade quickly.

(81 posts)They have all since posted bond, which was set at $300 per person. Since they did so, their court dates will be pushed back to a later date. They are all free to leave the state and can return home.
Coeur dAlene Police say this is common with misdemeanor charges. A warrant will be put out for their arrests if they do not appear at their scheduled court date.
Those future court dates have not yet been set.

Maybe this is grounds for subpoenas that will lead investigators to commucations and other evidence that they were up to much worse. If nothing else, I hope they give them a thorough enema to make sure they werent.
