Medical Marijuana legal now? |
|
I seen last week where the Obama administration said they would no longer prosecute medical marijuana cases. I would say that that says there is now medical marijuana in the USA. What would you say?

I think Holder said they would no longer bust people for their meds in the states where it has been legalized.
That leaves 36 or so states that need to change the laws on the books.

They aren't going to bust people for it in their states. That would mean they are recognizing the medical benefit of it. no? Therefore each state would not need it's own law. The fed says it has medical use, it can't be schedule 1 anymore, so it's in limbo, or it's legal.

First off, the Fed Gov't has not said, "it has medical use". They have only said the DEA will "no longer raid Medical Marijuana clinics". That leaves open a lot of room for prosecutions. It also means that in states without clinics, Marijuana is still ILLEGAL. Here in MA it has been decriminalized and the potential is that you can just be written a ticket... BUT, that is up to the discretion of the officer.
We are however headed in the right direction. If the newest effort by a California State Legislator to make it legal and TAX it in CA could actually create precedent for REALLY legalizing it.
But i'm not holding my breath...

That kind of blows the theory that it has no medicinal value, but logic is not exactly their forte'.
The dumbass federal laws are still on the books, and need to be done away with.

Again I must ask, think about what you said. They are not going to raid medical clinics. ok now WHY NOT?,,,,because there is a medical use for it. That is what is meant by these actions. How can you not infer that from these actions? The only way the fed's can say "ok you can perceive it", is by recognizing a medical use for it. Granted they didn't come right out and say it,but, is that not exactly what you would infer by there actions. They are recognizing a medical use for it, otherwise they would be still busting them,no? I understand they didn't come right out and say it's legal,but, they did say it with their actions.,,,lol

Today in the IL senate Medical Marijuana passed 4 to 3. So your argument no longer applies. We now have medical marijuana in IL.,,,lol

what holder said is that they are not going to bust people for MJ possession in jurisdictions where the states HAVE legalized it vis a vis medical MJ and the person possessed it for medical reasons.
iow, they are deferring to the states.
they are not saying they are de facto legalizing mj.
it *is* still schedule I
the feds are NOT necessarily saying they agree it has medical uses. what they are saying is that they are not going to supersede the state's autonomy to make that decision.
essentially, it's a victory for federalism or "states rights", not so much medical mj imo
regardless, they have not changed the schedule nor have they said they won't go after OTHER MJ violators.

And we got it legalized in Marin County, CA a year before that.
The DEA are a bunch of sadistic fucking thugs, who ignore our laws.
Hopefully they have now been reigned in, and will no longer be harassing providers and patients.
It should be legal for recreational use as well. The sooner the better. It could save our economy. :smoke:

the DEA are part of the executive branch. they can't change the laws. they are following FEDERAL law , which is enacted by LEGISLATORS not the DEA.
i work in law enforcement. i know many DEA agents. heck, i know many who believe that MJ should be decrim'd or legalized.
regardless, federal law is NOT their fault. it is the fault of congress. congress has the power to change these laws.
blame them.

I am trying to fight it out in the courts now. I have a add i the paper to see if I can get a attorney to file a claim for me. I believe I should be able to at least get the current laws thrown out for lack of evidence. They cannot keep lying to people saying it has no medical values. They refuse to re-classify it into schedule 3 or 4, where it should be. The government has changed it's position on weather it has medical value. I should be able to get the judge to throw out the current laws since the state would have to show how it should be schedule 1 , and they can't. Anyone that can help with this is welcome to reply. And those that can't , you can also reply. You do have a freedom of speech still, I think they haven't taken that right , YET.

then I would be happy with that. I hurt my back playing highschool football. It is hard to go to sleep and stay asleep sometimes because of the pain. Double need oh yeah.

For example, Medical marijuana was just legalized in New Jersey by outgoing Governor Corzine but will not be available to physician-certified patients until around September. The new governor, Christie, a gluttonous, deformed, authoritarian swine, is opposed to the new law and intends to make dispensing marijuana to certified recipients as restrictive as possible.
He is restricting access to medical marijuana by limiting the number of dispensaries to six for the entire state and guidelines for prescribing physicians are being established to ensure that anyone certified to receive it are suffering the miseries of Hell. Briefly stated, this morbidly obese power freak is determined to preclude as much pleasure as possible.
