Being a convicted felon in possession has been a federal crime since congress passed the Federal Firearms Act of 1938. The Gun Control Act of 1968 made it a mandatory minimum five year sentence. If he was never convicted of anything before, do you have a problem with due process?

The full answer is to claim anything even vaguely to do with firearms is all part of a very successful NRA/GOP plot. That's why it's the fault of the NRA that a gangster had guns.
