2. I'm no expert on the subject, but I don't think you're fingerprinted until the time of arrest.

In situations covered by the class-action lawsuit, the people whose samples are unwittingly being taken are only "possible suspects." They are being interviewed, but they have not been arrested.

The police are proceeding on the premise that these are the sort of people who will probably commit a crime someday, so let's be proactive and collect their DNA now.
