Smith's hands are tied by our justice system that is rigged to benefit the rich.

When TSF's lawyers file frivolous motions/appeals which Cannon could simply deny but instead she schedules hearings to resolve them, what is Smith supposed to do? Cannon is abusing the justice system but not doing so in a way to get her removed.

Now when she finally rules on Smith's request to gag TSF from lying about the FBI using lethal force on TSF, and if she denies Smith's request then she will be gone. Smith can't just go over her head willy nilly and think that the highly conservative 11th circuit will grant his appeal, it must be rock solid.
