Biden was apparently "trading" the confirmation of two U.S. Attorneys, in return for the appointment of a Republican anti-abortion Federal Judge. The Judgeship is a lifetime appointment, the U.S. Attorneys serve at the pleasure of the President, which some regard as a somewhat shortsighted trade. The lack of U.S. District Attorneys doesn't much hamper the Justice Department from functioning, as there are deputy Attorneys in place who fill the vacant seat on a temporary basis. Adding another lifetime Judge approved by McConnell is likely to have much greater long term consequences than some vacant U.S. Attorney positions.
