2. I suppose it depends on the video, but I have a hard time seeing this successfully prosecuted.

I would expect the relevant statute or the reality of getting a conviction to require some meaningful preparation or actions that clearly demonstrate an intent to follow through.

Unless she had half a million in cash in her car, or had been stalking this family, it sounds too easy to say it was just a joke or in any event that she wasn't serious about actually doing it.

I think it's possible that she was *probably* serious, but i don't beyond a reasonable doubt.

Again, the video and other facts may uncover supporting evidence, so and arrest and investigation seems appropriate. Just saying I don't see a conviction as of yet.
