The maximum penalty in it is 20 years in prison - not death by hanging.

This is why he wants to bring Senator Mark Kelly back on active duty; the military's Article 94 allows for death sentences to be issued. However, the last time anyone was brought up on Article 94 charges was during the Civil War.
