Federal Judge Freezes Trump's Chicago Military Deployment [View all]

A federal judge Thursday froze President Donald Trump’s attempt to deploy hundreds of National Guard troops in and around Chicago, saying the president lacked the authority to do so.

U.S. District Judge April Perry, an appointee of former President Joe Biden, found that the Trump administration’s account of recent protests in Chicago were not credible and could not amount to a “rebellion” against the federal government.

“I have seen no credible evidence that there is danger of rebellion in the state of Illinois,” Perry, ruling from the bench, said.

The judge temporarily enjoined the Trump administration from ordering the federalization and deployment of the National Guard within Illinois.

The judge disagreed with the Trump administration’s assessment that agents have not been able to carry out federal law in Chicago, noting that deportations and arrests were up and courthouses remained open and functional.

The judge noted that a military deployment in Chicago, rather than soothing conditions, would likely incite further unrest.

Judge April Perry made the ruling from the bench Thursday at the Everett McKinley Dirksen U.S. Courthouse in downtown Chicago.

Perry said not even the most ardent Federalist, Alexander Hamilton, believed one state’s militia could be sent to another state for political retribution.

Christopher Wells, division chief of the Illinois Attorney General’s Office, said there is no rebellion in Illinois to justify the deployment of federal troops.

“War and insurrection are heavy words, and the people who wrote the Constitution did not use them lightly,” Wells said in his opening remarks.

The judge said she was “troubled” by what she described as a disconnect between the official orders from the federal government directing the activities of military troops in Chicago and the public statements made by the president about what their duties are in the city.

Perry said that tactics used by immigration agents in Chicago so far have only increased the risk of protests, and that bringing in the National Guard would only make matters worse.

She also rejected the president’s claim that his actions were lawful because protests against his immigration crackdown in Chicago posed the risk of rebellion against US government authority.

“Evidence demonstrates that the deployment of the National Guard will lead to civil unrest,” she said.
