If ICE detains a U.S. citizen without proper legal basis, it can be considered a violation of their civil rights. The Federal Tort Claims Act (FTCA) allows individuals to sue the federal government for wrongful acts committed by its employees, including ICE agents, in the course of their official duties, including detaining a U.S. citizen based on mistaken identity, lack of probable cause, or other violations of their civil rights. The FTCA can also be used by non-citizens who have been harmed by ICE actions.
