On June 19, 2022, Mr. Trump's Director of Strategic Communications, Alyssa Farah Griffin, reported on CNN's program "State of the Union" that at some point between Election Day 2020 and the beginning of the post-election transition process Mr. Trump had yelled out, in response to seeing President-Elect Biden appearing on television, "Can you believe I lost to this guy?"

Because then-President Trump was fully aware that he had in fact lost the election, any actions he took to attempt to remain in office were performed outside the scope of his official duties and, therefore, were not covered by any grant of presidential immunity.

Further, some of his actions - such as pressuring the then-Vice President to ignore the will of the people and in organizing a mob to attack the Capitol in an attempt to justify a declaration of martial law - could in no way be viewed as an official duty of a president.
