Donald Trump was dealt a blow in writer E. Jean Carrolls remaining case against him, as the US Justice Department said there isnt enough evidence to conclude that he was acting within the scope of his employment as president in 2019 when he allegedly defamed her by claiming she had lied about an alleged sexual assault.
The finding, outlined in a letter filed Tuesday in federal court in Manhattan, reverses an earlier opinion by the Biden administration and removes a final barrier to a trial set to start in January.
The Justice Department previously concluded that Trump was protected from the suit by the Westfall Act, a law that bars civil suits against employees of the federal government over allegations that relate to their official duties.
The government revisited the issue after a District of Columbia appeals court clarified a key issue about the law and a federal jury in Manhattan found Trump liable for sexually abusing Carroll in a parallel lawsuit she filed against him last year.
