First, as strong as the case against Fox might be, I would not venture a prediction as to the outcome. Four and a half decades of legal practice has taught me that there are few "slam dunk" cases, particularly in the area of defamation.

Second, if the case goes to trial and Fox loses, they will appeal. And any settlement discussions that might occur will begin in earnest only after the trial court decision is issued.
