5. Those are arguments in favor of repealing 2A... not for a court ignoring it

Except #2... which simply isn't true. There were certainly some militia that were used to round up escaped slaves, but that was in no sense the "concept behind" the amendment.


Regardless... courts can't say "we don't need that one any longer" and ignore a constitutional provision. If we don't need it any longer, the amendment needs to be repealed.
