and then asking questions. Asking her to rely on her memory was not working. She just said she “could not remember, it was a long time ago.” She was a terrible witness but one that had to be used. She was, no doubt, very nervous and ill at ease. But her demeanor was not good. Thank goodness her video speaks for itself. But since she shot the video, she had to testify.

In the future, video of her performance will be used to show a poor witness. But since her testimony was necessary to introduce the video into evidence, the attorney showed how you slowly and methodically get her to give the testimony you need.

As an aside, I was a witness to a murder and had to testify. I was so nervous (and the trial was not being broadcast to millions) and very aware as the only other person present to see the murderer shoot the victim, that I was speaking for the victim. I was there to tell the jury the things that only an eye witness could know. So I pulled myself together and did what I had to do. So I know what that 23 year old young woman had to do was hard. We should cut her some slack because she is not sophisticated or highly educated. She showed up as a witness in a sweatshirt and pants. Maybe that was all she had. She is probably doing the best she can. She videoed the incident because she said the “cops were always messing with people. And that’s not right.” So we need to be glad she did recognize that something was happening that was not supposed to be unfolding the way it was. And she took video of it adding to the body of evidence.
