5. States and cities can order masks for buses and trains and subways.

They don't need the federal government to do that. It was a disastrous decision to keep the subways operating in NYC. It spread the disease all over the city. The subways have no ventilation and are packed. There is no practical way to enforce no masks on busses and subways.
