As far as "can he?". Yes that is beyond any possible doubt. Any possible constitutional issues end on Jan 20 at noon. They could have an arrest warrant waiting and take him into custody as he walks out of the white house.

Will he be prosecuted and go to prison? He certainly should but I have my doubts.
