Qualified Immunity is an "ancient" doctrine that in its present form was invented by Antonin Scalia.

Qualified Immunity is an “ancient” doctrine that in its present form was invented out of whole cloth by Antonin Scalia.

It may have been Scalia’s worst hypocrisy. It should be abolished by legislation, since the conservative originalists on the Court won’t undo it.
