Ruling on Utah Amendment D ballot question expected Thursday morning

SALT LAKE CITY (ABC4) — After hearing arguments during an emergency hearing Wednesday afternoon, Utah 3rd Dist. Judge Dianna Gibson could rule as early as tonight on whether the controversial Amendment D will remain on the Nov. 5 ballot.

However, Gibson’s ruling is more likely to drop first thing Thursday morning, Sept. 12.

At stake is whether or not voters will get to decide the fate of an amendment to the Utah Constitution on the sanctity of citizen-led initiatives for future elections.

Whether or not the ruling allows the vote to go forward in November, the losing side in today’s court battle could also petition the Utah Supreme Court to step in for another emergency hearing on Thursday.
