Ohio Supreme Court rules on Maumee recall efforts
MAUMEE, Ohio The Ohio Supreme Court has blocked a proposed recall election targeting the mayor and six city council members in Maumee, ruling that the state law cited in the recall petitions does not apply to the charter city.
In a unanimous opinion issued Thursday, the court granted a writ of prohibition to prevent the Lucas County Board of Elections from placing the recall questions on the Sept. 9 special primary ballot. The justices found that the board "acted in clear disregard of applicable law" by allowing the process to move forward under the Ohio Revised Code.
The case centered on seven petitions filed earlier this year seeking the removal of Maumee Mayor James MacDonald and councilmembers Ted Kurt, Margo Puffenberger, Scott Noonan, Gabriel Barrow, Joshua Harris and Jonathan Fiscus.
The petitions were submitted under a revised code (R.C.) that outlined the process for voters to recall municipal officials, provided the municipality has adopted the statute as part of its government structure. Maumee officials and residents challenged the recall effort, arguing that the city never adopted the statute and that Maumees charter provides no such recall procedure.
