ICE Agents Can Now Be Arrested in Chicago

A FEDERAL JUDGE IN CHICAGO RULED last Wednesday that starting this week ICE agents can now face arrest and contempt proceedings if they conduct unlawful, warrantless arrests, marking a dramatic shift in immigration enforcement oversight in the city.

U.S. District Judge Jeffrey Cummings found that ICE agents violated the terms of a consent decree by detaining people without proper warrants, following a surge in such arrests amid increased enforcement activity. According to the judge’s order, ICE agents must now wear body cameras and have them turned on. They also cannot arrest anyone complying with their appointment dates at immigration courthouses.

The latest order expands protections for immigrants, mandating rigorous reporting and retraining requirements for agents and creating court-backed avenues for legal consequences—including possible arrest—for those found violating the judge’s directive.

The ruling stems from heightened scrutiny over “collateral arrests” made in the Chicago area, which often occur during street stops or raids without pre-issued warrants. Under the new decree, ICE agents must document and justify every warrantless arrest; failure to comply could result in agents being named and referred for prosecution or contempt proceedings.

This means Gov. Pritzker and Mayor Johnson will not have to stand by helplessly while Trump's goons terrorize Chicago and its suburbs. ICE agents will no longer be able to arrest any random person with brown skin who happens to enter their field of vision; they will have to have actual warrants, and they will also be required to wear body cams AND have them turned on. If they don't comply, local law enforcement will be empowered to arrest them. This is a whole new level of accountability for those thugs, and I love it!

Id argue that police already can and always could step in to prevent unidentified masked men from kidnapping people, literally anywhere in the country that has police.

Will they? Id be surprised to see it happen. Police are not trained or indoctrinated to stand against authority.

I honestly don't know the answer to that question. I also don't know why police haven't already been arresting these goons in Chicago and elsewhere, and I don't know all the details of this lawsuit or have time to look into it right now.

It does appear from what I've been reading elsewhere that the main effect of this ruling will be to prevent ICE from arresting people at courthouses when they show up for mandated immigration hearings and other court appearances. If so, that still sounds like an important step to me.

Cook County's top judge has signed an order barring ICE from arresting people at courthouses. Cook County includes Chicago, which has seen a federal immigration crackdown in recent months.

Detaining residents outside court has been a common tactic for federal agents, who have been stationed outside county courthouses for weeks, making arrests and drawing crowds of protesters.

As for what the police will actually do, that remains to be seen. But I know that lawmakers and regular folks in this blue state and in the very blue city of Chicago are up in arms about what has been going on, and I'm sure that the Chicago PD, the Illinois State Police, and other LE agencies are well aware of that. I would prefer to give them a chance and see what happens, rather than assuume that they're not going to do their job.

But my observation so far is that law enforcement have been well indoctrinated in reenforcing power against citizens and extremely lacking in protecting citizens against questionable authority. Almost like they are part of a system that has been building towards authoritarian control for a long time.

I need to do more research, but I think the judge is acting under powers granted in the 2022 Castañon Nava settlement/consent decree.

So the judge is taking action that they could not otherwise do "on their own motion."

In addition to Illinois, Missouri, Kansas, Indiana, Wisconsin, and Kentucky are subject to the 2022 Castañon Nava settlement/consent decree.

and really it's state-level charges that they have mostly been violating---
(assault, assault and battery, and possibly MURDER in a few cases, etc)

and violations of the United States Constitution on a broader basis....

about their citizens being grabbed off the street without even the pretense of a lawful arrest. Especially when said citizen is, in fact, an American citizen, as has happened more than once... a lot more than once. So far, as near as I can find, close to 200.

and make sure your local state reps know this. It prevents law enforcement guys who commit crimes against people (even rotten people) from hiding behind the job and the badge to escape anything bt an internatl investigation and maybe a suspension without pay. I can tell you from experience in NM that the police have gotten the message and are a hell of a lot more professional than they were, say, ten years ago. And yes, the first investigation is internal. If a serious crime was committed, it goes to a grand jury. That's the difference.

Qualified immunity is a shitty idea no matter who it gets applied to, cops or presidents. Hiding crimes is never a good idea.

and police are not getting charged into non existence. Just knowing if they do the crime, they'll get charged seems to be enough to keep the slightly bent ones in line. The truly twisted ones read the writing on the wall and saught alternative employment.

It's working out well for all of us.

When we invest that much power and authority in a policng agency they damn well better follow the law--to the letter!

PS. While we're at it: Lose the mask, show a warrant or arrest order, and prominently display a badge since you , Mr. ICE agent, are operating under color of authority.
