Totally get your frustration. Groundwater issues are a nightmare. HOA's power can be overwhelming. Instead of hiring a contractor who might worsen the situation, pursuing legal action could have been more straightforward. Now, the financial uncertainty is a big risk. Better planning could have saved a lot of hassle.

Groundwater, foundations waterlogged, softening soil. It's a community sitting on a lake.

HOA's usually win everything, sort of a private mutual contractual eminent domain.

Why hire a contractor to make the problem worse instead of just suing for use of her property? Monetarily could have been worked out. Now the costs are unknown.

HOA communities typically have rights-of-way along property borders for utilities installations -- including stormwater drains.
