Mike Flynn Pleads the 5th; He Should be Ordered to Active Duty & Court-Martialed for his Crimes - GK

Retired Army General and former National Security Advisor Mike Flynn just appeared before the House select committee investigating the insurrection. As reported by the New York Times, Flynn refused to testify about the attack on the US Capitol, invoking his 5th Amendment right against self-incrimination.

I've been a JAG chief prosecutor who has supervised two recalls to active duty for court-martial.

It's not an easy process.

It's usually reserved for conduct done on active duty before retirement that escaped recognition.

Both my cases involved child sex assault that wasn't uncovered until after retirement and I am proud to say both resulted in convictions.

I was, at the time, one of the few with experience in this, because it is rare. It tends to be for crimes like rape and murder, and it tends to be for crimes that happened on active duty.

So, whether one thinks he should be recalled understand it would be a new precedent to recall and try someone for a crime done after retirement and not rape or murder that I'm aware of. Not something done easily and knowing who is in the current leadership of JAG not something I anticipate ever happening.

Ty for prosecuting the offenders!

So disgusting that Flynn retains his title & all the perks!

I hope the govt. can find a way!
