The former FBI director James Comey is set to make his first appearance in court on Wednesday in connection with federal charges that he lied to Congress in 2020.
Comey will be booked and fingerprinted, which is normal practice for defendants, at the federal courthouse in Alexandria, Virginia, before being arraigned and formally read the charges against him by US district judge Michael Nachmanoff. Nachmanoff was appointed to the federal bench by Joe Biden in 2021.
The FBI has reportedly been weighing whether to submit Comey to a perp walk in which they would parade him in front of media cameras. An FBI agent was reportedly relieved of duty for refusing to participate in such an effort.
The brief indictment handed down by a federal grand jury on 25 September accused Comey of making a false statement and obstructing a congressional investigation in connection with his September 2020 testimony to Congress. While the details of the charge remain unclear, they appear to be related to his claim that he never authorized anyone in the FBI to be an anonymous source in news stories. I have great confidence in the federal judicial system and Im innocent. So lets have a trial. And keep the faith, Comey said in a video statement the night the charges were filed.

(2,581 posts)since there is no valid legal foundation. But I also have the feeling he may try to take it to court, so he can use the discovery phase to expose Trump..

It's going to be a pleasure watching Comey destroy this prosecutor at trial, if the charges aren't dismissed first.

The federal indictment on which the former FBI director was arraigned in a Virginia courtroom outside Washington on Wednesday is the product of a grand jury presentation Halligan made herself last month over the objection of career prosecutors as the statute of limitations window was closing. Further suggesting that her new colleagues think the case lacks merit is that Halligan was the only lawyer for the government listed on the docket until Tuesday, when two federal prosecutors from North Carolina entered their appearances alongside her.
Grand jurors rejected one of the three counts Halligan presented but approved two others: one for allegedly lying to Congress and another for allegedly obstructing Congress.
Halligans theory of the case isnt entirely clear from the indictment, which is somewhat vague and limited. But it centers on Comeys September 2020 congressional testimony over whether he authorized anyone at the bureau to be an anonymous source in news reports related to an FBI investigation. The indictment accuses him of falsely stating that he hadnt granted such authorization.

(16,658 posts)Comey is smart. Comey is not the run of the mill idiot who is going to cow tow to Trump, and I would go out on a limb and say that anything that comes up to attack Comey's character morally is going to be manufactured. I doubt that Comey has ever looked at another women since he married, I doubt he's ever cheated a penny on his taxes, and I doubt he has even ever spit on the sidewalk.
This is going to be interesting, and they are just assholes and jerks for putting this man and his family through this. I may not like the man, but I damn sure do not approve of this treatment of him just because Trump is having a tantrum.
