An awkward live TV moment for White House deputy chief of staff Stephen Miller is under heavy scrutiny on social media.
On Monday afternoon, the Donald Trump aide went on CNNs News Central to discuss the Presidents deployment of National Guard troops to U.S. cities.
CNN asked Miller whether the Trump Administration will abide by a district judges order blocking the Guards deployment in Oregon. Well, the Administration filed an appeal this morning with the Ninth Circuit, Miller began. I would note the Administration won an identical case in the Ninth Circuit just a few months ago with respect to the federalizing of the California National Guard.
Then, Miller said: Under Title 10 of the U.S. Code, the President has plenary authority, has before making an abrupt stop. Miller blinked several times, with anchor Boris Sanchez calling out his name, though he still did not respond.
Stephen, I apologize. It seems like were having a technical issue, Sanchez said, before the show cut to a break, and resumed after with Sanchez saying some wires got crossed. The interview with Miller continued, but neither Sanchez nor Miller brought up plenary authority again. CNN did not immediately respond when asked by TIME for comment on what exactly the technical issue was.
The brief moment sparked controversy online over Millers use of the phrase plenary authority, which Cornell Universitys Legal Information Institute defines as power that is wide-ranging, broadly construed, and often limitless for all practical purposes.
Some users speculated that there was no malfunction during the interview but rather that Miller abruptly caught himself and stopped talking. One TikTok user said, Stephen Miller said the quiet part out loud accidentally and then appeared to glitch, all of a sudden when he recognized how much of his foot he just put into his mouth. The user added: He just came out and said Trump is authoritarian. Another TikTok user posted a video with more than 100,000 likes: Stephen Miller absolutely did not have a glitch on live TV. He had an Oh sh-t moment where he said something that he f-cking was not supposed to say.

Regardless, it's clear he let the cat out of the bag so to speak. Got caught, and then demanded a do over.

CNN doesn't post every minute of their stuff as youtube videos. I don't think it was nefarious on CNN's part to not put that on youtube, I would not have expected them to post a video of something that went awry. I doubt whoever assembles clips for youtube was even aware of the significance of what happened there, and that instead of the aborted segment being an incomplete bit of story that, by itself, would not be worth posting, it was, in fact, perhaps the most important part of the interview!

"Plenary authority" is power that is full, complete, and unrestricted in scope. When used in reference to public officials, the term "plenary power" is more common.

Miller could have dug them a nasty whole to climb out of had Trumps future actions brought them to court again.

If they had simply lost the audio, you'd have seen Miller's lips continue to move.
If something had gone awry on Miller's end, like if he lost his monitor of the feed, or his earpiece starting making noise, or whatever... anything unexpected that would cause him to stop talking mid-thought... you would have seen a reaction from him, whether a change of expression , or saying there was an issue, or reaching his hand to his earpiece, etc.
He stopped either because he panicked because he realized he screwed up, or (I think more likely) because someone on his team indicated to him that he needed to shut up. (Not someone from CNN indicating that there was an issue, because again, you'd expect that to elicit some kind of reaction... rather, someone whose instruction he simply knew to follow.)
And then, when they came back after the break, he repeated the same talking point nearly word for word, except with that phrase omitted.

Thats my take on it. Anything else, like a mental glitch, is wishful thinking.

On Saturday afternoon, Miller took additional steps down the same right-wing path. The Democrat [sic] Party has filled our legal and judicial system with radicals who protect leftwing terrorists, the White House official wrote online. This is a very real and dire crisis for our Republican form of government.
Less than an hour later, he kept going, publishing this related missive:
The issue before is [sic] now is very simple and clear. There is a large and growing movement of leftwing terrorism in this country. It is well organized and funded. And it is shielded by far-left Democrat [sic] judges, prosecutors and attorneys general. The only remedy is to use legitimate state power to dismantle terrorism and terror networks.
.....A day later, according to an NBC News tally, Miller used the word insurrection at least 12 times over the course of Monday.
The essence of post-liberalism is the rejection of the notion that some neutral standards of conduct apply to all parties, The Atlantics Jon Chait explained in his latest column. Miller, like Trump, appears to believe his side stands for what is right and good, and his opponents stand for what is evil. Any methods used by Trump are ipso facto justified, and any methods used against him illegitimate.
There might be a temptation to shrug this off, but that would be a mistake. Theres a growing body of evidence that suggests Miller isnt just a hyper-partisan anti-immigration zealot, he also appears to be a leading White House official with a decision-making role related to military resources.
The deputy chief of staffs vision of a vast left-wing conspiracy is obviously weird and fantastical, but that doesnt mean its irrelevant.
