PORTLAND, Ore. — A federal judge has issued a ruling on Oregon's lawsuit challenging the federal deployment of the state's National Guard to Portland. U.S. District Judge Karin Immergut granted the state's motion for a temporary restraining order over President Donald Trump's order to deploy 200 National Guard troops to the city.

The temporary restraining order expires Oct. 18.

The ruling comes after a hearing Friday morning concluded with no immediate decision. Immergut began the hearing by asking questions of each side and allowing them about half an hour each to make their case.

Immergut was assigned to the case Thursday evening after U.S. District Judge Michael H. Simon recused himself. Oregon Attorney General Dan Rayfield filed the federal lawsuit against the Trump administration in late September.

"This is a nation of Constitutional law, not martial law," the Trump appointed judge wrote.

A federal judge in Portland, Oregon temporarily blocked President Trump's federalization of 200 members of the state's National Guard.

On Saturday, U.S. District Court Judge Karin Immergut granted a temporary restraining order filed by the City of Portland and State of Oregon, halting Trump's deployment at least through Oct. 17, when she will hear arguments over whether to extend the restraining order.

"This country has a longstanding and foundational tradition of resistance to government overreach, especially in the form of military intrusion into civil affairs," Immergut wrote in her order.

"This is a nation of Constitutional law, not martial law," she concluded. "Defendants have made a range of arguments that, if accepted, risk blurring the line between civil and military federal power--to the detriment of this nation.

A judge on Saturday ordered the Trump administration to halt its mobilization of 200 Oregon National Guard troops to protect the ICE building in Portland and its officers amid nightly protests.

U.S. Department of Justice lawyers have vowed to immediately appeal the ruling and ask the 9th U.S. Circuit Court of Appeals to put a hold on the judge's order.

In a 31-page opinion, U.S. District Judge Karin J. Immergut rejected the federal government's assertion that Portland faces a "danger of rebellion" and said she wasn't persuaded by the U.S. Justice Department's argument that "regular forces" are unable to execute federal law.

Lawyers for the U.S. government also failed to show that federal officers need backup from the National Guard to protect the U.S. Immigration and Customs Enforcement building or themselves, Immergut found.
