Pulitzer Board dumps broad discovery demands on Trump for financial and medical records.

The @PulitzerPrizes board is demanding @realDonaldTrump turn over his psychiatric and medical records in discovery as part of his lawsuit against the board.




Pulitzer Prize Board members filed court documents in Okeechobee County, Florida, on Thursday, containing a litany of broad discovery demands in an attempt to beat back President Donald Trump's defamation lawsuit over Russia probe reporting awards.

The board defendants are demanding documentation on subjects ranging from Trump's demands to rescind the awards, to his threats to sue, to proof that the board statement at issue "had a significant impact on the 2020 presidential election," and to Trump's various lawsuits

The defendants further demanded "all" of Trump's tax returns — "from all jurisdictions, including all attachments, schedules, and worksheets" — from 2015 to the present day, documents "sufficient to show all sources of Your income" over the same time period, documents "sufficient to show all of Your financial holdings" and his liabilities, and finally his health records and prescription medication history.

Distress and anguish etc, financial damage, reputational damage ( )

The records are relevant to that I believe.

To the extent that Trump claims he suffered psychologically and financially, the Board is demanding that he prove it.

That's not to say that they haven't also maximised their request for discovery for tactical reasons.

The scope of discovery is broad.

For instance, in a deposition, your attorney can preserve objections, but can't, with narrow exceptions, instruct or allow you not to answer.

For interrogatories, you can seek admissible information or information that might reasonably lead to admissible information.

IOW: Once you sue somebody, prepare to have your entire life examined.

Things may not be admissible in court, but they most likely can be found out in discovery.

Relevance is still the initial threshold.

Florida Rule of Civil Procedure 1.280(c)(1):

In General. Parties may obtain discovery regarding any nonprivileged matter that is relevant to any party’s claim or defense and proportional to the needs of the case, considering the importance of the issues at stake in the action, the amount in
controversy, the parties’ relative access to relevant information, the parties’ resources, the importance of the discovery in resolving the issues, and whether the burden or expense of the proposed discovery outweighs its likely benefit. Information within this scope of discovery need not be admissible in evidence to be discoverable.


Discovery is not a fishing expedition, and a court can enter orders limiting or denying discovery on certain issues.

On motion by a party or by the person from whom discovery is sought, and for good cause shown, the court in which the action is pending may make any order to
protect a party or person from annoyance, embarrassment, oppression, or undue burden or expense that justice requires,


Florida Rule of Civil Procedure 1.280(d)(1).

Federal Rule of Civil Procedure 26 is virtually identical.

The County where the case was brought is deep deep red -- over 76 percent voted for Trump. The elected judges in the county will suppress the discovery request as soon as Trump asks them to do so.

The state court judges in Okeechobee are elected in what are described as "non partisan" contests. But it would be naive to think that the judges in the county are anything other than Trumpers and that they won't rule in Trump's favor when he moves to quash these discovery requests as overbroad. Not saying it would be the correct decision -- it wouldn't -- but just suggesting that there is no way Trump drops his complaint because of this discovery request.
