US to deport Abrego Garcia to Liberia as soon as Oct. 31

BALTIMORE (AP) — The U.S. government plans to deport Kilmar Abrego Garcia to Liberia, and could do so as early as Oct. 31, according to a Friday court filing.

The Salvadoran national’s case has become a magnet for opposition to President Donald Trump’s immigration policies since he was mistakenly deported to El Salvador, in violation of a settlement agreement. He was returned to the U.S. in June after the U.S. Supreme Court said the administration had to work to bring him back. Since he cannot be re-deported to El Salvador, ICE has been seeking to deport him to a series of African countries.

Meanwhile, a federal judge in Maryland has previously barred his immediate deportation. Abrego Garcia’s lawsuit there claims the Trump administration is illegally using the deportation process to punish him for the embarrassment of his earlier mistaken deportation.

A Friday court filing from the Department of Homeland Security notes that “Liberia is a thriving democracy and one of the United States’s closest partners on the African continent.” Its national language is English; its constitution “provides robust protections for human rights;” and Liberia is “committed to the humane treatment of refugees,” the filing reads. It concludes that Abrego Garcia could be deported as soon as Oct. 31.

3. He goes nowhere until the court rules on dismissal of the criminal charges for vindictive prosecution. Hearing 11/3.

Judge Waverly Crenshaw Jr., previously granted Abrego Garcia a hearing on his vindictive prosecution claim.

Crenshaw found there was a "realistic likelihood of vindictiveness" based on the timing of the criminal charges, which came over two years after the traffic stop and shortly after Abrego Garcia's lawsuit gained national attention.

I need to get my head back in this case. I am mystified that they are trying to deport him. If they believed in the criminal case, wouldn't they want him here to appear when it is scheduled to begin 1/27/2026?

Or are they so sure the case will be dismissed as vindictive that they are setting up next steps?

This is absolutely infuriating. They are destroying this man’s life to hide the fact that he was unjustly accused and imprisoned. His children have got to be completely traumatized at this point. If Liberia is such a great place to be exiled, let’s remember that when this regime is over.

8. Unfortunately, if Liberia is not on the list his lawyers have previously provided, he might have run out of options.

In a filing with a federal judge in Maryland, Justice Department lawyers said that immigration officials expect to formally notify Abrego Garcia later Friday that Liberia has been designated as the new country of removal. They said the Trump administration expects to be able to deport Abrego Garcia as soon as Oct. 31.

The administration has "received diplomatic assurances regarding the treatment of third-country individuals removed to Liberia from the United States and are making the final necessary arrangements for [Abrego Garcia's] removal," they wrote.

In the court filing, the Justice Department said that Abrego Garcia had identified more than 20 countries that he fears would persecute or torture him if he were removed there, and Liberia is not on the list.

"Liberia is a thriving democracy and one of the United States's closest partners on the African continent," they wrote.
