(16,454 posts)to justify such detentions and arrests. He writes entire paragraphs, inventing scenarios where ICE agents will now be able to "reasonably suspect" anyone who looks hispanic and to detain them. It's a legal opinion sanctioning racism.

(1,646 posts)require, as a condition of being granted that status, that the person carry their papers with them? If so I guess that ICE was within their rights to ticket him. If not it was just more BS harassment. Does anyone out there know the answer?

Someone else can argue the law with you, but I want to know what the actual harm is here. It appears ICE was the only one with bruised feelings about this because they couldn't hold and deport him.
There doesn't appear to be any threat or even reasonable suspicion that this person did anything wrong outside of this 'mass deportation' regime where every brown person is required to prove they're not eligible for them to snatch off of the street, detain, abuse in jail, and deport.
A former dishwasher, Cruz lives in a government-funded apartment but isnt working due to his health. Cruz said he was relieved to be released but worries how he will pay the fine. The ICE agents told Cruz he has to pay it within 60 days or go to court.
Its not fair because I said, lets go to my house and Ill show you my papers. Im a resident, Cruz said.

...the answer is, yes, he is required to carry his green card, but this is rarely enforced, outside of other crimes associated with the stop.
Besides, the things are so fucking easy to lose that MANY people have just left them home in a safe place like you'd do your ss card.
I'd argue that it's not only a no-consequence crime to anyone other than this politicized regime of cruelty and punishment against people just trying to live their lives, but no American has to go through this.
This is a computerized age where almost nothing is dependent on paper. In my reasonably long life I've been driving and pulled over without having my license with me and have never gotten a ticket. It's absurd to think I would in this century. I gave one cop my license number from memory.
This is punitive without a damn reason other than republicans wanting to push Latin Americans and Mexican Americans around.
I know out of my reasonably long life experience that white people aren't made to endure this indignity, and that's an abomination against people of color.
The penalties should only be imposed for actual crime committed, not for walking down the fucking street, and EVERY cop, and every court has the power to make that judgment.
But not fucking ICE. They get to lord their white supremacy over people like they own them. It's no wonder why they're beside themselves with fear of the people of color they're treating like 'enemies within.'
Let's not just ignore the anti-American context behind all of this heightened enforcement. Who's next on their list of people that need to carry papers?

...though I heard a lawyer say today that ICE isn't accepting those on face value either.
They just take every opportunity to take brown people back to their shitty jail to rough them up and mistreat them while they look for something to keep holding them and possibly deport them.
There no ICE professionalism. It's a state-sponsored KKK militia
