The deputy had the man take a breathalyzer test and the results showed a 0.000% blood alcohol content, according to the lawsuit. During a horizontal gaze test, the man showed zero out of six indicators of intoxication, the complaint said.
However, the deputy noted that the man showed four out of eight indicators of intoxication during the walk and turn test and four out of four indicators during the one leg stand test, the lawsuit said.

(25,260 posts)victim, where some of the indicators of a stroke are the very things that inebriated sometimes show, unsteady walk, slurred words, disorientated...the breath test showed 100% clean, why did it take them 7 hours to catch?

(15,366 posts)are designed for you to fail, he said you never, ever agree to take one, even if you're stone cold sober, always ask for the breathalyzer or blood draw.

(15,366 posts)No, under Arizona law, field sobriety tests are not mandatory for all drivers. Unlike chemical tests, which carry legal consequences for refusal, drivers generally have the right to refuse field sobriety tests without penalties to their drivers license. However, its crucial to note that refusing these tests may still result in arrest if the officer has other grounds for suspicion of impairment.

Refusing any of those results in suspension or revocation.
Haven't handled a DUI case in 8 years and it showed!

And, walking a dead straight line is a sometimes thing.
And, I barely drink.
But, I'd just say "I have MS. I'm not doing a test I know I can't do."
But, I would never consent to the test.

(1,616 posts)When you know you have had nothing to drink and things seem a bit out of sorts with the test, declare you are having a medical emergency and ask immediately for a medical response unit to the police officer. At that point, he/she should call for aid. The key thing is, get it on record as soon as possible.
