Man jailed 7 hours for DWI was really having stroke, Missouri suit says

The man was driving from Springfield to Republic, heading to work, when he was pulled over in his job’s parking lot by a Greene County sheriff’s deputy, according to the civil complaint.

In his report, the deputy noted that the man’s car was weaving and that he suspected him of driving while intoxicated, the lawsuit said. However, the man denied using any alcohol or drugs.

The deputy had the man take a breathalyzer test and the results showed a 0.000% blood alcohol content, according to the lawsuit. During a horizontal gaze test, the man showed zero out of six indicators of intoxication, the complaint said.

However, the deputy noted that the man showed four out of eight indicators of intoxication during the walk and turn test and four out of four indicators during the one leg stand test, the lawsuit said.

victim, where some of the indicators of a stroke are the very things that inebriated sometimes show, unsteady walk, slurred words, disorientated...the breath test showed 100% clean, why did it take them 7 hours to catch?

are designed for you to fail, he said you never, ever agree to take one, even if you're stone cold sober, always ask for the breathalyzer or blood draw.

Which is breath, blood or urine.

Refusing any of those results in suspension or revocation.

Haven't handled a DUI case in 8 years and it showed!

I've had MS for 30 years. Balancing on one foot is hard for me.
And, walking a dead straight line is a sometimes thing.
And, I barely drink.
But, I'd just say "I have MS. I'm not doing a test I know I can't do."
But, I would never consent to the test.

When you know you have had nothing to drink and things seem a bit out of sorts with the test, declare you are having a medical emergency and ask immediately for a medical response unit to the police officer. At that point, he/she should call for aid. The key thing is, get it on record as soon as possible.

So I know first hand. I wasn't discussing necessarily about a stroke, but about any situation. For all you know, you may be having a heart attack or another event.
