NEW: In a new filing, special counsel Jack Smith's team says Trump bears responsibility for the Jan. 6 attack on the U.S. Capitol.

…the superseding indictment plainly alleges that the defendant willfully caused his supporters to obstruct and attempt to obstruct the proceeding by summoning them to Washington, D.C., and then directing them to march to the Capitol to pressure the Vice President and legislators to reject the legitimate certificates and instead rely on the fraudulent electoral certificates."

NEW: Judge: Trump Could Be On The Hook For Jan. 6 Riots — Even If He Didn’t Give Marching Orders

___The judge overseeing Donald Trump’s Jan. 6 election subversion case issued an order on Wednesday mostly denying Trump’s requests for discovery materials that he says will vindicate him at trial.

While prosecutors must provide defendants with exculpatory materials, Judge Tanya Chutkan said Trump was too vague and too speculative about how certain records go toward proving his state of mind (for example: a request for classified information from the Office of the Director of National Intelligence about Russian interference in the 2016 election is irrelevant).

Notably, the order expressed that it’s possible Trump could “share the responsibility” for the Capitol attack even if he did not give direct marching orders.

Before Chutkan’s order, Smith reiterated that Trump “willfully caused” people to obstruct the certification of the 2020 election as he pushed back on attempts by Trump to dismiss two of his charges following the Supreme Court’s Fischer v. United States decision.
