They can operate under a speaker pro tem. An acting speaker.

The first time around, no members had actually been sworn in and no regular business could be conducted.

That isn't the case right now. They can still operate ss though the speaker was sick or out of town.

So in effect, the second in command takes over and runs the show until a new speaker is elected, if ever.

Now the best anyone can come up with is it is uncharted waters.

This situation has never occurred before. There are no existing house rules to address it.

But the house is in session, the leadership is elected, and members are sworn in. They can vote on any rules package they choose, or any bill. It will be legal.

My guess is they will try to elect a speaker, but they will fail. So they will try to govern with an acting head.

The dems will raise a procedural rules fuss, but I'm not sure it will succeed.
