New York law on jury trials does not extend to equitable relief. That is an oversimplification, but accurate. They did not ask for one. Courts only decide issues that are raised.

5. Not so sure that applies here, only one portion has been decided by summary judgement there

is still 6 (I believe) other charges to be determined through trial. The Judge made note at the trial today that his lawyers did not request a jury trial.
