Translation: Sure we are openly defying a 5-4 SCOTUS ruling but we think Justice Kavanaugh will flip

“we strongly believe that the Legislature’s map complies with the Voting Rights Act and the recent decision of the U.S. Supreme Court,” Alabama Attorney General Steve Marshall said in a statement. #alpolitics

Alabama will appeal rejection of map to U.S. Supreme Court

Translation: Sure we are openly defying a 5-4 SCOTUS ruling but we think Justice Kavanaugh will flip his vote if we come back at him with the exact argument he told us to make when he sided against us last time

Alabama’s gonna “raise that temporal argument” and hope Kavanaugh thinks that the Voting Rights Act no longer should authorize “race-based redistricting.”

Question is whether Kav left that loaded gun out for immediate use or for some years from now.

The three-judge district court opinion smacking down Alabama’s defiance contained a section on Kavanaugh’s concurrence to show why Alabama must lose but completely ignored the part where Kav wrote how Alabama could have won—and may yet still win—his vote https://s3.documentcloud.org/documents/23936075/milligan-2023-09-05-order.pdf

Anyway Alabama’s play has been obvious from the start

And if Kavanaugh’s ready but is skittish about rewarding Alabama’s specific defiance in his name, Louisiana’s already saying PICK ME PICK ME

But then there’s also Kav’s good friend Purcell if he doesn’t want to kill the VRA just yet and CA5 does the dirty work

*until CA5 rogues out by sitting on the case for months and then hands down a decision sidestepping Allen v Milligan to uphold Louisiana’s maps several months before the 2024 election such that five justices will be all TOO CLOSE TO ELECTION CAN’T STEP IN NOW MAINTAIN STATUS QUO

Kev has some more bills that he needs paid by a mystery person/organization.

Pay the bills he's run up, take him on a fancy vacation and BOOM! You have the ruling you want.

Isn't that how the current right wing SCOTUS works?
