SCOTUS is above the law...

...realistically speaking.

Their importance in the American political system (as opposed to the judicial system) is unassailable.

Once nominated and confirmed, they can only be charged for a crime after being impeached. Even if charged, being appealed to the Supreme Court, the charged justice will win any appeal before his or her colleagues. The decision will undoubtedly be that charges can only be brought after impeachment by the House and conviction by the Senate.

Considering that conviction will need 67 Senate votes, no political party is giving up such an important position as one of their votes on the Supreme Court. Unless there is a political earthquake, I cannot envision either party reaching 67 Senators.

Practically speaking, the Supreme Court is above the law both in ethics and philosophy. This situation may end up being a fatal flaw to American Democracy.

...FDR couldn't do it with three quarter majorities in both branches of Congress and the most political capital since George Washington.

The only answer is to develop large majorities in Congress, a Democratic President and enough political capital to change the laws.

As far as enlarging the court, you certainly will need more than a one vote majority in the Senate and a slim majority in the House. You would need overwhelming support and a national consensus. I just don't see that happening any time soon.

I didn't say it would happen, I do not think it will but it is still the best way, second best is take over both houses and potus and kick ass from there.

is, for all intents and purposes, is akin to "terraforming" the U.S. so that it's easier to implement what the Corporate overlords and preachers want to achieve. They're breaking all precedents, as long as it falls into this wide band of accepted behavior for their most favored benefactors. And, like mosts repugs, they absolutely have no shame whatsoever... even those who declare their ever-loving faith in god.
