Kristen Waggoner, the Alliance Defending Freedom's attorney arguing in favor of anti-LGBTQ discrimination, was forced to admit that the photographer would be able to say they would not take photos of Black children with a white Santa.

Later, Justice Samuel Alito, one of the Court's most far-right jurists, decided to use Justice Jackson's hypothetical analogy to make a point, and he did so by mockingly joking about Black children wearing KKK costumes.

I used to have a kind of unquestioning faith in the Supreme Court — until this one came into full bloom like a gigantic Titan arum corpse flower.

Right! I used to feel that way about the three branches of government. There were some jackasses in both Houses of Congress. And I am disgusted by some republicans in the House that are in no way qualified -- unlike some of the crooks and creeps of the past, who were qualified but shitheads. This Herschel Walker things makes me want to vomit.

I thought after Nixon, the presidency would be safe. No Goldwater '64 campaign, no Tricky Dick in the future. How wrong I was.

I started really losing faith with the USSC when they selected Bush for president. There was no justification for them doing so. It has been to my horror to see the quality of republican appointments to the court since then.

A censure or other resolution would be in order. Democrats should have been doing that with all these Supreme Court outrages all along.

It would be great politics from the Democrats:

Was the worst he could get. Seems there is no bottom to that black hole of Alito's racist, bigoted and misogynistic heart. I hope America will be able to hang on to some semblance of civilization when this idiot is done with it.

The only good thing about this scum is that he's a lot older than me, so I'll be able to live in a world when he is long dead.

“And presumably,” Justice Sonia Sotomayor interjected, “that would be the same Ku Klux Klan outfit regardless whether if the child was Black or white or any other characteristic.”

“Justice Jackson’s example of that, the Santa in the mall who doesn’t want his picture taken with Black children,” Justice Alito began, getting the basics of the analogy incorrect.

That’s when Alito decided to make a “joke,” while thousands of Americans were listening to the Court’s live proceedings.

“So if there’s a Black Santa at the other end of the mall, and he doesn’t want to have his picture taken with a child who is dressed up in a Ku Klux Klan outfit, now does that Black Santa have to do that?”

He then laughed, and some viewers in the gallery joined with him

People who can do anything they want and still have lifetime appointments are a problem. Six justices are turning the SC into a kangaroo court that deserves absolutely no respect. If we need a Constitutional Amendment to establish term limits, then we need to get started on that now. Of course, it could not happen quickly because Republicans would obstruct, but at least Dems would be on the record for wanting to end lifetime appointments, and for all federal judges, not just the SC. Trump’s incompetent Judge Cannon is a perfect example of why lifetime appointments are bad.

The only requirement in the Constitution is that judges serve with good behavior, but that behavior is not defined. I’m wondering if Congress can put some rules around that behavior or whether an amendment would also be needed to expand that requirement.

I’m all in favor of expanding the SC by four now, but it would still needs some changes.
